BABYSITTING SERVICES AGREEMENT, FEES, & POLICIES

Effective March 1, 2026
This Babysitting Services Agreement (“Agreement”) is entered into between Southern Coast Nannies, LLC (“SCN,” “Agency”) and the booking parent(s) or legal guardian(s) (“Family”). This Agreement shall be governed by and interpreted under the laws of the State of North Carolina.
By checking the agreement box or submitting a booking request, the Family agrees to all terms below.
1. Agency Role & Relationship of Parties
Southern Coast Nannies is a referral and booking agency that connects Families with independent childcare providers (“Sitters”). Sitters are not employees or partners of SCN. SCN does not supervise, control, or direct Sitters, and does not co‑employ Sitters with Families.
Families retain full responsibility for childcare decisions during bookings. Childcare services are provided directly by the Sitter to the Family. SCN may conduct background screenings; however, screening does not guarantee future conduct or performance. Families are responsible for evaluating sitter suitability.
2. Platform-Based Booking
All bookings are submitted and confirmed through SCN’s booking platform. The Family acknowledges that booking details submitted through the platform — including hourly rate offered, number of children, booking duration, and special requirements — are selected and confirmed by the Family at the time of booking.
The Family assumes responsibility for the accuracy and adequacy of submitted booking information. Sitters retain sole discretion to accept or decline any booking. SCN does not guarantee booking acceptance regardless of rate offered. A booking is confirmed once it is accepted by a Sitter through the booking platform.
3. Booking Time Minimums
All babysitting bookings require a three (3) hour minimum of paid hours based on the hourly rate offered by the Family and accepted through the platform. Families agree to pay for all reserved hours, even if care ends early. Additional time beyond the reserved hours must be compensated directly to the Sitter at the agreed upon rate in 30 minute increments.
4. Standard Agency Booking Fee
For standard bookings, SCN charges twenty-six ($26) dollars per booking per day. This fee is non-refundable and earned upon confirmation of bookings.
5.Last-Minute Agency Booking Fee
If the Family needs a Sitter with less than twenty-four (24) hours prior notice, the Family will pay an additional back-up care fee of fifteen ($15.00) dollars if SCN is able to match the Family with a Sitter, for a total amount of forty-one ($41) dollars. Last minute booking fees are waived for monthly memberships.
6. Monthly Memberships
Our Monthly Care Membership allows Families to book a babysitter up to four (4) times per month with no agency booking fees. Members also receive waived urgency fees for last-minute requests and enjoy a reduced booking fee of twenty-one ($21) dollars—instead of twenty-six ($26) dollars—for any additional bookings beyond the included four (4) within the same month.
Our Unlimited Care Membership allows Families to enjoy unlimited babysitting bookings per month, with waived urgency fees for last minute requests.
All Membership fees are billed on the first (1st) of each month and apply to services during that same month. A 30-day notice is required to pause or cancel a membership. Unused bookings do not carry over to the following month.
7. Sitter Rates and Compensation
SCN establishes a minimum sitter hourly rate for bookings based on industry and location standards. Families may offer an hourly rate at or above the minimum rate through the app. SCN may provide rate guidance for various types of bookings. These suggested rates are guidance only and do not guarantee booking acceptance. Seventeen dollars and fifty cents($17.50) is the minimum hourly rate per sitter. Families are solely responsible for paying Sitters at the end of each booking via a mutually agreed upon method.
If payment is not made, SCN may, but is not obligated to, charge the payment method on file for sitter compensation and applicable administrative fees of fifteen ($15) dollars.
8. Holiday Booking Fee & Rates
For designated holidays or high-demand dates SCN’s booking fee shall be forty-two ($42) dollars per booking per day and the Sitter rate shall start at thirty-five ($35) dollars per hour.
Holiday availability is not guaranteed. Holiday dates are considered to be New Year’s Day, Easter, Mother’s Day, Memorial Day, Father’s Day, Fourth of July, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day, or the evenings of Valentine’s Day and New Year's Eve.
9. Payment Authorization
Family authorizes SCN to charge the payment method on file for agency booking fees, cancellation fees, last-minute fees, holiday fees, administrative or convenience charges, and unpaid sitter compensation if Family fails to pay directly. Returned payments or charge backs may result in additional administrative fees and suspension of booking privileges.
10. Cancellation Policy
If the Family cancels a confirmed job with less than twenty-four (24) hours’ notice, a cancellation fee of fifty dollars ($50.00) per Sitter will apply. If the Family cancels after the Sitter has arrived at the job location, the cancellation fee increases to seventy-five dollars ($75.00) per Sitter.
11. Sick Child Policy
If a Family’s child should fall ill twenty-four (24) hours before care is to be rendered by a Sitter, SCN must be contacted. Families must disclose any illness or symptoms prior to care. Sitters retain sole discretion to accept or decline sick care. If SCN is not notified of a sick child and the Sitter shows up to a sick home, there will be a twenty-five dollar ($25.00) inconvenience fee in addition to the booking fee.
12. Overnight Care
For bookings that include overnight care, Families agree to compensate the Sitter at the agreed-upon hourly rate for all scheduled hours, except during designated sleeping hours.
Sleeping hours are defined by SCN as 12:00 AM through 7:00 AM and shall be compensated at a flat overnight rate of one-hundred twenty ($120) dollars, provided that the child(ren) sleep(s) through the night and the Sitter is not required to actively provide care.
If the Sitter is expected to provide care during sleeping hours, or if the child(ren) wake(s) and require(s) active care beyond occasional assistance, the agreed-upon hourly rate shall apply for the entire overnight period. Families must clearly disclose overnight care expectations at the time of booking. Families must also provide safe sleeping accommodations and restroom access.
13. Home Safety & Disclosure
For any booking, Families agree to provide:
A safe, sanitary, and hazard-free environment
Disclosure of pets
Disclosure of cameras or recording devices
Emergency contact information
Failure to disclose safety issues may result in termination of services and/or interruption of childcare services.
14. Inclement Weather & Emergencies
Sitters and SCN reserve sole discretion to cancel, delay, or decline travel due to weather or safety concerns. Cancellation penalties may be waived at SCN’s discretion under such conditions.
15. Replacement Policy
If a Sitter becomes unavailable, SCN will make reasonable efforts to locate a replacement but does not guarantee replacement care. SCN shall not be liable for losses resulting from unavailable coverage.
16. Non-Solicitation & Non-Circumvention
The Family acknowledges that SCN invests significant time, funds, resources, and business goodwill in recruiting, screening, and introducing Sitters. During the term of this Agreement and for a period of twelve (12) months following the Family’s last booking through SCN, the Family agrees that they shall not directly hire, employ, contract with, or otherwise engage a Sitter introduced through SCN outside of the SCN platform or without SCN’s written consent; or attempt to circumvent SCN’s booking system or agency fees by arranging childcare services directly with a Sitter introduced by SCN.
If the Family wishes to hire or engage a Sitter outside the SCN platform, the Family must first contact SCN and comply with any applicable direct-hire or conversion fee requirements in effect at that time. The Family acknowledges that violation of this section would cause financial harm to SCN and agrees that SCN may pursue recovery of actual damages and reasonable attorney’s fees to the extent permitted by North Carolina law.
17. Limitation of Liability & Indemnification
To the fullest extent permitted by North Carolina law: SCN shall not be liable for acts, errors, omissions, or conduct of Sitters, SCN shall not be responsible for indirect, incidental, or consequential damages, and Families assume all risks associated with in-home childcare services.
Family agrees to indemnify and hold harmless SCN, its owners, employees, and representatives from claims, damages, or expenses arising from childcare services occurring in the Family’s home.
18. Revisions to Fees & Policies
SCN may update fees and policies from time to time, and the version in effect at the time of booking will apply.
19. Dispute Resolution
Parties agree to attempt good-faith mediation prior to filing legal action. If unresolved, disputes shall be brought exclusively in the state or federal courts located in New Hanover County, North Carolina.
This Agreement constitutes the entire agreement between the parties and supersedes prior communications or representations.
